The Elgin City Council has called on the U.S. Congress and Senate to pass legislation that would prohibit federal agents, including those from U.S. Immigration and Customs Enforcement (ICE), from wearing face masks.
Currently, there is no federal law that prevents ICE or other federal agents from wearing masks while operating in Elgin. As a result, masked federal agents may continue to be present in the city.
The Elgin Police Department stated it cannot take action against federal agents for wearing masks unless such a law is enacted at the national level.
According to existing policy, "The Elgin Police Department will continue following its established policies and state law that prohibit its police officers from assisting ICE or any other federal agents with civil immigration enforcement."
City officials also emphasized their ongoing commitment: "The city will continue to act within its authority to ensure a safe, welcoming and inclusive community for everyone who calls Elgin home."
