Petition #4596 BIG ROCK TOWNSHIP

Petitioner: Old Second National Bank Trust #668 (Gum Family Farm)

Location: 46W763 Wheeler Road (13-14-100-001)

Proposed: Rezoning a portion of property from F-District Farming to F-1 District Rural Residential to allow the existing farmette to be sold off from the surrounding farmland

Zoning Board: Approve with the following stipulation:

1. 1. Development as defined by the Kane County Stormwater Management Ordinance on the resulting F1 and F parcels that singularly results in greater than 5,000 sq ft of new impervious area, or cumulatively (as of Jan 1, 2002) results in greater than 25,000 sq ft of new impervious area shall provide Stormwater Management Measures as required by the Kane County Stormwater Ordinance. If the total new impervious exceeds 25,000 sq ft , all lot and parcel owners shall jointly cause the design, permitting and construction of a Detention Storage Facility and off-site outfall (if required) that will store and release runoff from the new impervious areas. The lot and parcel owners will develop and implement a maintenance plan for the Detention Storage Facility, record an easement over the Detention Storage Facility and establish a Special Service Area for said Detention Storage Facility (and off site outfall – if required). The building or stormwater permit for the Development that results in the exceedance of the 25,000 sq ft of new impervious area will not be released until a Stormwater Management Permit is issued for the Detention Storage Facility as outlined above.

Proposed: Special Use in the B-3 Business District to allow outdoor storage or vehicles and equipment

Zoning Board: Approval with the recommended stipulations:

1. Water Resources will require a Stormwater Permit.

This permit will include an evaluation of the increased impervious surfaces on site and a Stormwater Management Plan for this site. This plan will need to include a Best Management Practice to reduce neighborhood flooding as well as a maintenance plan for the channel to the east. Any maintenance or grading work within the ROW or within any parcels owned by the City of Elgin needs to be permitted with the City of Elgin. As the road is owned by Elgin the Stormwater Management Plan will need to be approved by both County and City of Elgin.

2. That slatting be installed on the fencing for screening.
