Member Kious reported a clarification that would be reflected in the approved minutes.

3. Monthly Financials

The financial reports were attached to the agenda for review. Chair Martin suggested members contact the finance department with any specific questions.

4. Public Comment

(Chair Martin changed the order of the agenda and directed the committee to item 7)

Martin noted this would allow the speakers that have requested to speak regarding the vacation of roadway discussion in item 7 to address the committee earlier in the agenda.

5. Building & Zoning Division

A. Building & Zoning Report

Dir. VanKerkhoff reported the uptick in building permits continued. He also noted the development department continued to field neighborhood concerns County wide that typically they shared with the public health department.

B. Zoning Petitions

Dir VanKerkhoff acknowledged the petitions have been reviewed and approved by the Building and Zoning Appeals Board.

6. Planning & Special Projects

Dir. VanKerkhoff acknowledged the planning and special projects reports were attached to the agenda and are on file. He gave a brief oral summary.

7. Subdivision

(Item 7 was discussed earlier in the agenda)

A. Vacation of Roadway Reservation

Dir. Wollnik reported today the committee would only be discussing the removal of a restriction from the parcel at 4N560 Babson Lane located in District 20 (St. Charles Township) and noted this is not an action item. She used a visual aerial photo to identify the parcel for the committee. Dir. Wollnik reported the request was for the removal of a restriction that stated reserved for future roadway to the parcel. She noted the parcel is on the north side of the property and a roadway would extend Babson Lane to the west. Fire Chief John Nixon acknowledged his interest in whether or not this restriction was removed and stated he needed more background information before he could discuss further.

Chair Martin reported the legal status and the state's attorney's office request for more time to review. He noted today there was little to discuss as a committee and acknowledged the public speakers. Nixon acknowledged the long dead end road does create an obstacle and reviewed other accesses utilized. He questioned the future development in the areas to the west. Further discussion occurred. Wollnik reviewed the County and International Fire Code (IFC) codes. She then responded to the committee’s questions. State's attorney Baxter reported to the committee she had spoken to Special Assistant State’s Attorney Pat Jaeger in regard to vacating or amending a plat. She noted their determination would be for the owner to follow the dedicated process with the township highway commissioner. Baxter reported if the parcel was not dedicated the land owner could then use a different process.

John Thornhill representation for the petitioner addressed the committee. He acknowledged that unfortunately this parcel was not dedicated. He would be seeking a simple map amendment to adjust the property line. James Gaffney the property owner addressed the committee and acknowledged conversation he’d had with other property owners. He stated they do not support making this parcel a road. He noted his intent was to utilize the property.

9. Water Resources

A. Ordinance: An Ordinance Proposing the Establishment of the 45W185 Plank Road Special Service Area (Or Special Service Area No. 54) of Kane County, Illinois and the Levy of Taxes for the Purpose of Paying the Cost of Fee-In-Lieu

Dir. Wollnik gave an oral report and recommended approval of the ordinance proposing the establishment of the 45W185 Plant Road Special Service Area.

B. Adele Court Cost-Share 21-01

Dir. Wollnik reviewed the cost share project and acknowledged the residents on Adele Court do receive significant water at the end of the hill and are requesting the installation of a storm sewer. The project total was $6900 would be a 67/33% split between the residents of Adele Court and Kane County.
