Petition #4569 CAMPTON TOWNSHIP

Petitioner: Martha Cabral

Location: 2N553 Pouley Road, Campton Township (08-33-200-010)

Proposed: Rezoning a portion of property from F-District Farming to B-3 District Business with a Special Use for a truck parking

Staff recommended stipulations:

1. The petitioner shall dedicate a 33-foot half right-of-way on Pouley Road to the Campton Township Highway Department.”

2. The improvements on the site will require a Stormwater Permit.

3. A BMP will be required to be constructed on the site.

4. Water Resources will require the applicant to record easements on the Floodplain and Wetlands prohibiting encroachment of any kind on these special management areas. The Easements will ensure that no fill, storage of materials or construction of any structures including fences will be allowed in these special management areas.

Petition #4570 KANEVILLE TOWNSHIP

Petitioner: Vernon Long, et ux

Proposed: Rezoning from F-District Farming to F-1 District Rural Residential to allow the creation of three residential parcels

Zoning Board: Approval with the following stipulations:

1. When establishing new access points, the owner shall coordinate with the Kaneville Township Road Commissioner to establish the safest access points possible for the 2 new parcels.

2. Each parcel shall have only one Harter Road access permitted with all new access locations requiring the review and approval of the Kaneville Township Road Commissioner to ensure safe access.

3. This site contains Wetlands and will require a Wetland delineation and Jurisdictional Decision by the USACE.

4. Development as defined by the Kane County Stormwater Management Ordinance on the resulting three F1 parcels that singularly results in greater than 5,000 sq ft of new impervious area, or cumulatively (as of Jan 1, 2002) results in greater than 25,000 sq ft of new impervious area shall provide Stormwater Management Measures as required by the Kane County Stormwater Ordinance. If the total new impervious exceeds 25,000 sq ft, all lot and parcel owners shall jointly cause the design, permitting and construction of a Detention Storage Facility and off-site outfall (if required) that will store and release runoff from the new impervious areas. The lot and parcel owners will develop and implement a maintenance plan for the Detention Storage Facility, record an easement over the Detention Storage Facility and establish a Special Service Area for said Detention Storage Facility (and off-site outfall – if required). The building permit for the Development that results in the exceedance of the 25,000 sq ft of new impervious area will not be released until a Stormwater Management Permit is issued for the Detention Storage Facility as outlined above.

(Please note that the existing house and any impervious area existing prior to 2002 located will not be considered towards the trigger for Stormwater Detention.)

5. The depth of a basement and height of the first floor for any new construction will be limited by the water table and the BFE, which includes the HWL of any Detention facilities.

(Please note that given these parameters a basement may not be possible at this location.)

Petition #4571 KANEVILLE TOWNSHIP

Petitioner: Ted Ranney

Location: 50W254 Keslinger Road, Kaneville Township (10-06-400-006) Proposed: Rezoning from F-District Farming to F-2 District - Agricultural related sales, service, processing, research, warehouse and marketing with a Special Use for tree service company

Zoning Board: Approval with the following stipulations:

1. The petitioner shall dedicate 60 feet of right-of-way from centerline of Keslinger Road to the County of Kane.

2. The proposed berm shall be set back so the southern toe of the berm is a minimum of 10 feet off the new right-of-way.

3. The owner shall widen (or verify that) the access drive is 22 feet wide, from the Keslinger Road edge of pavement to a point 100 feet north.

4. A Stormwater Permit will be required. The submittal should include the necessary Detention and BMPs required for the impervious areas added since 2001 and the proposed improvements, as required by the Stormwater Ordinance.

5. The site contains Floodplain as mapped by FEMA in the Flood Insurance Rate Maps. Water Resources will require the applicant to record easements on this special management area. The Easements will ensure that no fill, storage of materials or construction of any structures including fences will be allowed in the Floodplain.

6. A Drain tile study will be required.

7. County aerial photos indicate that parking area was added to the site in 2013. The parking area appears to be approaching the threshold for Stormwater Detention. Water Resources will require a survey and a submittal by a Professional Engineer showing the impervious area added to the site since 2001. Should this survey indicate 25,000 sq ft or more of impervious surface has been added to the site the applicant will be required to provide Stormwater Detention.
