City of St. Charles Liquor Control Commission met Sept. 21.

Here is the minutes provided by the commission:

1. Call to Order.

The meeting was called to order by Commissioner Rogina at 4:30 p.m.

2. Roll Call.

Present: Mr. Robert Gehm, Ms. Fran Zollers, Ald. Stellato, Ald. Pietryla

Absent: None

3. Motion to accept and place on file minutes of the Liquor Control Commission meeting held on August 17, 2020.

Motion by Mr. Gehm, second by Ald. Pietryla to accept and place on file the minutes of the Liquor Control Commission meeting held on August 17, 2020.

Voice Vote: Ayes: Unanimous; Nays None. Commissioner Rogina did not vote as Commissioner. Motion Carried.

4. Recommendation to approve an Ordinance Amending Title 5 “Business Licenses and Regulations”, Chapter 5.08 “Alcoholic Beverages”, of the St. Charles Municipal Code.

Chief Keegan explained that an audit was done of the City Code by Tom Bastian of Storino, Ramello & Durkin to ensure the City of St. Charles following industry best practices and standards. The items being revised are general housecleaning items.

Chief Keegan went over the redline document for each code amendment and highlighted the changes.

Ms. Zollers mentioned that the word “shall” was removed from section 5.08.020 and it should be included. Ms. Zollers agreed with the removal of the wording making it sound as if it’s a criminal action.

Ms. Zollers asked what the reasoning is for taking out the 7-day requirement in liquor.

Chief referenced 5.08.320 and said that 3 days notice is for the hearing, the establishment can be closed for up to 7 days and the finding for the hearing needs to be done in 5 days.

Motion by Ald. Stellato, second by Ald. Pietryla to Recommend to approve an Ordinance Amending Title 5 “Business Licenses and Regulations”, Chapter 5.08 “Alcoholic Beverages”, of the St. Charles Municipal Code.

Roll Call: Ayes: Stellato, Gehm, Pietryla, Zollers; Nays: None. Commissioner Rogina did not vote as commissioner. Motion Carried.

5. Recommendation to approve an Ordinance Amending Title 5 “Business Licenses and Regulations”, Chapter 5.20 “Massage Establishments”, of the St. Charles Municipal Code.

Chief Keegan went over the redline document for each code amendment and highlighted the changes.

Motion by Mr. Gehm, second by Ms. Zollers to Recommend to approve an Ordinance Amending Title 5 “Business Licenses and Regulations”, Chapter 5.20 “Massage Establishments”, of the St. Charles Municipal Code.

6. Recommendation to approve an Ordinance Amending Title 5 “Business Licenses and Regulations”, Chapter 5.09 “Video Gaming”, of the St. Charles Municipal Code.

Chief Keegan went over the redline document for each code amendment and highlighted the changes.

Chief Keegan noted that the State now requires video surveillance of each machine’s transaction. The video terminal supplier is responsible for the installation of this equipment.

Motion by Ald. Stellato, second by Ald. Pietryla to recommend to approve an Ordinance Amending Title 5 “Business Licenses and Regulations”, Chapter 5.09 “Video Gaming”, of the St. Charles Municipal Code.

Roll Call: Ayes: Stellato, Gehm, Pietryla, Zollers; Nays: None. Commissioner Rogina did not vote as commissioner. Motion Carried.

7. Recommendation to approve an Ordinance Amending Title 5 “Business Licenses and Regulations”, Chapter 5.16 “Tobacco”, of the St. Charles Municipal Code.

Chief Keegan went over the redline document for each code amendment and highlighted the changes.

Ms. Zollers asked if someone checks to ensure that there is no money owed to the City before applying for a new license or when renewing a license. Chief Keegan answered that it is verified prior to renewal or applying.

Motion by Mr. Gehm, second by Ald. Stellato to recommend the approval of an Ordinance Amending Title 5 “Business Licenses and Regulations”, Chapter 5.16 “Tobacco”, of the St. Charles Municipal Code.

Roll Call: Ayes: Stellato, Gehm, Pietryla, Zollers; Nays: None. Commissioner Rogina did not vote as commissioner. Motion Carried.

8. Recommendation to approve a Proposal for an A-1 Liquor License Application for Mr. A’s Prairie and Liquor, Located at 1401 Prairie St., St. Charles.

Chief Keegan explained that the petitioners own and operate three liquor stores in West Chicago, IL. As part of the background check the West Chicago Police Department was contacted and there was no derogatory information pertaining to the applicants, or their stores. They would like to operate the business in St. Charles as it stands.

Ms. Zollers asked for an updated business plan and noted that they have $450 in sales listed. The applicant stated that it should be $450,000.

Ald. Pietryla asked what their hours of operation will be. The applicant answered that they will be open 10:00 a.m. to 10:00 p.m.

Ald. Zollers noted that their application has them as a corporation but they are an LLC.

Ald. Zollers asked if they have filed their DBA. The applicant said they haven’t done that because they are waiting for approval of the license.

Ald. Zollers asked who is making the purchasing decisions. The applicant stated that he makes purchasing decisions.

Motion by Ms. Zollers, second by Mr. Gehm to recommend approval of a proposal for an A-1 Liquor License Application for Mr. A’s Prairie and Liquor, Located at 1401 Prairie St., St. Charles.

Roll Call: Ayes: Stellato, Gehm, Pietryla, Zollers; Nays: None. Commissioner Rogina did not vote as commissioner. Motion Carried.

9. Public Comment.

10. Executive Session (5 ILCS 120/2 (c)(4)).

11. Adjournment.

Motion by Ald. Pietryla, second by Ms. Zollers to adjourn the meeting at 4:33 p.m.
