Village of Burlington Village Board met Dec. 16.

Here is the minutes provided by the board:

Present: Village President Bob Walsh, Village Clerk Katie Adams, Deputy Clerk Marilyn Diede, Village Attorney Rick Petesch, Treasurer Mitch Dander and Public Works Director Mark Wilkison.

Open the Meeting: Village President Bob Walsh opened the meeting at 7:00 p.m. and led the Pledge of Allegiance.

Roll Call: Trustees: Jim Daffron, Deb Twenhafel, Jon Millen, Mary Kay Wlezen, Ernie Jackson and John Totemeier were present.

Guests: Deputy Matt Humm (Kane County Sheriff).

Absent: Village Engineer John Whitehouse.

Trustee Deb Twenhafel made a motion to go into a Public Hearing to approve the Property Tax Levy Increase and Trustee Jim Daffron seconded the motion. Ayes: Trustees: Deb Twenhafel, Jim Daffron, Mary Kay Wlezen, Jon Millen, Ernie Jackson and John Totemeier. Six ayes, motion carried.

The Board went into the Public Hearing at 7:01 p.m.

It was noted the current Tax Levy amount being proposed is $138,000 for 2019-2020. Last year the Village received $100,218.19 from the County. The Truth in Taxation notice is a.3769% increase over last year. This number is put in to capture all growth of the Village. The appropriate notice of the Public Hearing was published in the Eglin Courier News on 12/6/19 and has been posted in accordance with law.

There was no Public Comment.

Trustee Deb Twenhafel made a motion to Close the Public Hearing and Trustee Jim Daffron seconded the motion. Ayes: Trustees: Deb Twenhafel, Jim Daffron, Jon Millen, Ernie Jackson, John Totemeier and Mary Kay Wlezen. Six ayes, motion carried.

The Public Hearing closed at 7:03 p.m.

The Board meeting reconvened at 7:03 p.m.

Board Action on Ordinance 2019-12 Tax Levy Ordinance, May 1, 2019 – April 30, 2020: Trustee Ernie Jackson made a motion to adopt Ordinance 2019-12 and Trustee John Totemeier seconded the motion. Trustees: Ernie Jackson, John Totemeier, Jim Daffron, Deb Twenhafel, Jon Millen and Mary Kay Wlezen. Six ayes, motion carried.

Board Action on Ordinance 2019-13 Tax Levy Ordinance SSA No. 2, May 1, 2019 – April 30, 2020: Trustee Deb Twenhafel made a motion to adopt Ordinance 2019-13 and Trustee John Totemeier seconded the motion. The purpose of this SSA is to levy $150 of taxes for the maintenance and storm water facilities on the Hamano property on McGough Road which includes a private golf course, maintenance building, the residences, etc. Trustees: Deb Twenhafel, John Totemeier, Ernie Jackson, Mary Kay Wlezen, Jim Daffron and Jon Millen. Six ayes, motion carried.

Approval of Minutes: Trustee Mary Kay Wlezen made a motion to approve the November 04, 2019 Village Board meeting minutes with two corrections and Trustee Deb Twenhafel seconded the motion. With corrections, ayes: Trustees: Mary Kay Wlezen, Deb Twenhafel, John Totemeier, Jim Daffron and Jon Millen. Abstain: Trustees: Ernie Jackson. Five ayes, one abstention, motion carried.

Trustee Deb Twenhafel made a motion to approve the November 18, 2019 Village Board meeting minutes and Trustee Jim Daffron seconded the motion. Ayes: Trustees: Jim Daffron, Deb Twenhafel, Jon Millen, Ernie Jackson, John Totemeier and Mary Kay Wlezen. Six ayes, motion carried.

Kane County Sheriff’s Report: DeputyMatt Humm reported numbers are way down in Burlington for the last month, however he feels they will go up with the holidays.

Deputy Humm updated the Board on the power outage that happened the previous evening due to a car rollover in a field off Peplow near Godfrey.

Deputy Humm left the meeting at 7:10 p.m.

Approval of the bills to be paid: Trustee Ernie Jackson made a motion to approve the bills to be paid as presented on Warrant 17 FY-2020, dated December 16, 2019 for $13,432.95. Trustee Mary Kay Wlezen seconded the motion. Ayes: Trustees: Ernie Jackson, Mary Kay Wlezen,John Totemeier, Jon Millen, Jim Daffron and Deb Twenhafel. Six ayes, motion carried.

Board Action on Authorizing Village President Bob Walsh to execute an Agreement with Cozen O’Connor regarding the Azavar Audit: Trustee Jim Daffron made a motion to approve executing the Cozen O’Connor Agreement and John Totemeier seconded the motion. It was noted this is the Attorney Azavar uses. Ayes: Trustees: Jim Daffron, John Totemeier, Mary Kay Wlezen, Jon Millen, Deb Twenhafel and Ernie Jackson. Six ayes, motion carried.

Board Discussion on Chicago Metropolitan Agency for Planning (CMAP) Village of Burlington’s Comprehensive Land Use Plan: President Walsh gave his thoughts on CMAP and feels the Village needs to find out what the residents and businesses want for the Village and this is the way to achieve that. The Comprehensive Plan is designed for the Village’s future and we will have no sense of direction without this plan. President Walsh went over the numbers that the Village will have to pay towards the Comprehensive Plan. The Village will require an Ordinance for this. Board Members asked questions, gave their thoughts and discussion followed. It was noted the BBC President will attend a Board Meeting in January.

Attorney Petesch said he will do some preliminary work on the Ordinance before the Board decides.

Board Discussion on Village of Burlington’s Intent Concerning Cannabis Sales: The Board is undecided on this topic.

Public Works Report: Director of Public Works Mark Wilkison presented his report and review dated December 12, 2019. Director Wilkison advised the board he will be on vacation during the week of Christmas, however will be in town in case of an emergency.

Water Plant Report: Mark Wilkison presented his report and review dated December 12, 2019.

Treasurer Report: Treasurer Mitch Dander went over the Budget. Under the General Fund he feels the Village is doing well in comparison to last year. He went over the Water Fund and reported it is a little behind in comparison to last year.

Treasurer Dander added a new column to the General Budget spreadsheet to show the previous year’s balance as requested.

Village Attorney’s Report: Attorney Rick Petesch informed the Board that AT&T has assigned their rights to the cell tower to Lend Lease Towers III, LLC. This does not change anything, the original lease provided for this.

Village Engineer’s Report: No report.

Zoning Enforcement Officer’s Report: No report.

Village Clerk’s Report: No report.

Village President’s Report: President Walsh updated the Board that the Clarke Mosquito Contract is ongoing and will be $3,116.10 for 2020.

There has been interest in the cutdown wood on Plank Rd at Well 5. Attorney Petesch will send over a simple hold harmless letter. Whoever takes the wood will be asked to sign this document.

President Walsh discussed the issue at 4:30am last Wednesday morning with the train track arms being down. A call was made to get the problem resolved to the phone number on the blue sign. This is a good number to report issues to.

President Walsh informed the Board that the reimbursement for the Plank Road Detention Basin project is forthcoming from KDOT.

Presentation and Review of Water Billing Memo: November Receipts were $8,152.32. Aged Receivables due at the end of November were $9,720.39. December Water Billing was $13,487.38.

Director of Public Works Mark Wilkison and Treasurer Mitch Dander left the meeting at 7:43 p.m.

Trustee Deb Twenhafel made a motion to go into an Executive/Closed Session for the purpose of: 5 ILCS 120/2(c)(6) the setting of a price for sale of leases of property owned by the public the public body. Trustee Mary Kay Wlezen seconded the motion. Ayes: Trustees: Deb Twenhafel, Mary Kay Wlezen,John Totemeier, Ernie Jackson, Jon Millen and Jim Daffron. Six ayes, motion carried.

The Board meeting reconvened at 7:51 p.m.

Board Action on Ordinance 2019-14, an Ordinance Approving the Sale of the Vacant Property at 254 N. Main Street for a List Price of $34,000. Trustee Mary Kay Wlezen made a motion to approve Ordinance 2019-14. Deb Twenhafel seconded the motion. Ayes: Trustees: Mary Kay Wlezen, Deb Twenhafel, Jim Daffron, Jon Millen, Ernie Jackson and John Totemeier. Six ayes, motion carried.

Adjournment: Trustee Deb Twenhafel made a motion to adjourn the meeting and Trustee Jim Daffron seconded the motion. Motion carried on voice vote. The meeting adjourned at 8:54pm.
