Petitioner: Brian McLean, et ux

Location: 2N152 Kautz Road, Section 36, St. Charles Township (09-36-476-016)

Proposed: Special Use in the F-Farming District for a dog kennel

2040 Plan: Commerce/Employment

Objectors: Area property owners

Recommendations: Regional Planning Comm.: N/A

Zoning Board: Approval with the following stipulations:

1.The Kane County Water Resources Division will require a BMP for the development.

2.The Kane County Water Resources Division will require a draintile investigation before any construction will be permitted. Repairs will be required if deemed necessary.

3. The acoustic fence construction, the building, enclosed building, and the drain tile investigation be completed to meet requirements and area property concerns.

Zoning Board: Approval with the following stipulations:

1. The petitioner work for Staff regarding evaluation of increased impervious surface and appropriate water management plan.

2. The petitioner determine the location of the septic system and review with Staff to ensure no parking in that location.

Petition #4542 HAMPSHIRE TOWNSHIP

Petitioner: Jenny Weber, et ux

Location: 44W906 Berner Road, Section 36, Hampshire Township (01-36-100-018)

Proposed: Special Uses in the E-1 District Estate Residential District for a retreat center and a Bed & Breakfast

2040 Plan: Rural Residential

Objectors: AREA PROPERTY OWNERS

Recommendations: Regional Planning Comm.: N/A

Zoning Board: (Two separate motions were made for each Special Use)

Approval of the retreat center with the following stipulations:

1. The maximum number of people allowed at one time would not exceed 25.

2. The hours would be limited from 8:00 am to 9:00 pm.

3. The petitioner will meet all the Hampshire Fire Department requirements.

4. Kane County Division of Transportation will require the petitioner to verify that a minimum 33’ half right of way has been dedicated from centerline of Berner Road. If such right of way does not exist, they will be required to dedicate a total of 33’ from centerline.

5. Kane County Division of Transportation will require the petitioner to widen the access to a minimum of 20’ wide, from the edge of existing pavement, to a distance of 50’ onto the property, so that 2 vehicles may pass safely while entering/existing the property.

6. The petitioner will work with the Kane County Health Department to research and ensure the septic system is adequate for the proposed use.

Approval of the Bed & Breakfast with the following stipulations:

1. No more than 12 guests allowed at one time.

2. The petitioner will meet all the Hampshire Fire Department requirements.
