1. Meeting Called to Order for the Plan Commission Meeting

Vice-Chair Schneider called the meeting to order at 7:00pm.

2. Roll Call:

Members Present: Vice-Chair Schneider; Commissioners Harms, Joseph, Peterson, and Gosselin

Members Absent:   Chair LaLonde; Commissioner McGrail

Also Present:          Joel Strassman, Planning and Zoning Officer; Drew Rackow, Planner; Jeff Albertson, Building Commissioner; and Jennifer Austin-Smith, Recording Secretary

3. Items to be Removed, Added or Changed

There were no items to be removed, added or changed.

4. Approval of Minutes: July 18, 2018

Motion:       To approve the minutes from July 18, 2018, August 1st and 15th of 2018

5. Public Hearing: Conditional Use Permit for Medical Offices and Clinic

      Geneva Family Practice, 815 North Randall Road

Motion:       To open the public hearing

Maker:        Joseph

Second:      Harms

Voice Vote:  5 Ayes, 0 Nays, 2 Absent

Motion carried.

Strassman reported that this property is part of the larger Walmart development annexed with a planned development in 2003. In 2013 the City Council amended the Planned Development to allow medical offices and clinics on this part of the planned development. This building is allowed to have medical uses with Conditional Use approval. This leased space formerly was an urgent care facility. Strassman noted that Dr. Rivers and Dr. Fahey are in attendance at tonight’s meeting.

Vice-Chair Schneider swore in Dr. Fahey so that he could address the Commission’s questions. Peterson asked about the retail sales at this location. Dr. Fahey explained that they have started a side business called Ideal Protein, which includes weight loss advice and protein powders and it has had remarkable success. He noted that it is not a large part of their business. Harms asked how many employees would be at the location. Dr. Fahey stated that they have three to four practitioners, each with a medical assistant, along with front office staffing. They have eighteen total employees but they do not all work at the same time. Dr. Fahey stated that the employees would be encouraged to park in the Wal-Mart parking lot to open up parking for their clients.

Motion:       To approve all four Findings of Fact as they appear on the staff memo dated September 26th submitted by staff

Motion:       To recommend to City Council approval of the Conditional Use Permit for medical offices and clinic

Strassman stated that this would be on the October 23, 2018 Committee of the Whole (COW) meeting agenda.

6. Approval of Preliminary/Final Plat of MIF Batavia Subdivision

      1100 North Raddant Road

      Midwest Industrial Fund Batavia, Applicant

Rackow showed the Plan Commission (PC) the being discussed tonight. He stated that the applicant submitted a Plat of Subdivision in order to: consolidate the lots, provide a dedication, and remove existing utility easements based on the old lot configurations. Staff has reviewed this as part of the building permit process and this approval would be taking care of necessary actions. Signature blocks are needed for private utilities and staff has received from the applicant an updated version of the plat but staff asks that the PC recommend approval subject to the addition of the utility blocks with the approval.

Motion:       To recommend approval of the Preliminary/Final Plat of MIF Batavia Subdivision, 1100 North Raddant Road as presented with addition of utility provider signature blocks

7. Matters from the Public (for items NOT on the agenda)

There were no matters from the public.

8. Other Business

Rackow announced that at the next PC meeting there would be public hearings for three properties that are existing retention ponds: Feece Drive, 1500 W Wilson Street, and Branford Circle. An additional public hearing is scheduled for review of a text amendment to address tattoo parlors and pawn shops in the Community Commercial zoning district. 

Strassman reported that the COW reviewed the PC’s recommendation for the Windmill Landings senior care facility on Hawkes Drive and recommended approval of all the actions; the City Council has already taken final action on the Comprehensive Plan amendment. The remainder of the approvals are scheduled for final action in front of the City Council October 15th.

Peterson asked about One North Washington and Strassman answered that staff is working with the consultant regarding the environmental issues, scope of work and remediation. Joseph asked about the demolition of the existing public parking garage. Albertson answered that there are no plans to take down the parking garage until the project commences.

Strassman reported that staff received an application for development of a property on Nagel Boulevard just southwest of the gas station. Rackow stated that they are looking to develop two buildings.

Strassman stated that staff has had applications in for several months for the Landmeier property, which is sixty-nine acres. The development would be for 113 single-family homes and 88 townhome units (22 townhome buildings).

9. Adjournment

There being no other business to discuss, Vice-Chair Schneider asked for a motion to adjourn the Plan Commission. Peterson moved to adjourn the meeting, Gosselin seconded. The motion carried. The meeting was adjourned at 7:21pm.
