City of Geneva Zoning Board of Appeals met March 22.

Here is the minutes provided by the Board:

Present:Chairman Pro tem Rittenhouse, Members Debates, Hunz, Kerfoot, Konicek7

AbsentMembers Hood and Konicek; Chairman Kaindl

Staff: Building Commissioner Eric Nelson

Public Present: Applicant Andrea Hemmer, 1452 Country Square Dr., Geneva; Planet Depos Court Rptr. Melanie Humphreys-Sonntag; Recording Secretary Celeste Weilandt

The meeting of the Zoning Board of Appeals was opened at 7:00 p.m. by Chairman Pro tem Rittenhouse.

The recording secretary called the roll and a quorum was present with four (4) voting members.

Approval of the February 22, 2017 Meeting Minutes

Minutes of the February 22, 2017 meeting were approved on motion by Mr. Kerfoot, seconded by Mr. Hunz. Voice vote:

Aye:Debates, Hunz, Kerfoot, Rittenhouse

Nay:None

Motion Carried. Vote: 4-0

Public Hearing

Chairman Pro tem Rittenhouse read the opening statement which explained the protocol for the hearing.

Mr. Eric Nelson read the legal notice that was published on March 2, 2017 in the Daily Herald newspaper.

The public hearing for the following case was opened.

A. 1452 Country Squire Drive – In accordance with Section 11-14-5 (Variations) of the Geneva Zoning Ordinance, the petitioner is requesting a variation from Section 11-3-5-C1 (Fences and Walls) to increase the maximum allowable fence height in the street yard from 3.5 feet to 5 feet.

Chairman Pro tem Rittenhouse invited the applicant to come forward.

Applicant/owner, Andrea Hemmer, 1452 Country Squire Drive, Geneva, IL explained she was requesting the variance because of safety but her lot was unique in that Western Avenue curves the opposite direction of her home, so the fence would not block anyone’s view of the stop sign. Ms. Hemmer stated she owned two dogs who liked to bark at people walking on Western Avenue and the fence would help reduce the noise. She stated she wanted to be a good neighbor.

Chairman Pro tem invited questions/comments from the board members. No questions followed. A motion was entertained.

Motion by Mr. Kerfoot, seconded by Ms. Debates to approve the request for a variation to increase the maximum allowable fence height in the street yard from 3.5 feet to 5 feet at 1452 Country Squire Drive. Roll call:

Aye:Debates, Hunz, Kerfoot, Rittenhouse

Nay:None 

Motion Carried. Vote: 4-0

Special Items – None.

Other Business – None.

Adjournment

There being no further business to come before the Geneva Zoning Board of Appeals, motion was made by Mr. Hunz to adjourn the meeting at 7:09 p.m. Seconded by Mr. Kerfoot. Motion carried unanimously by voice vote of. 4-0.
