After a four-day session marked by snowy conditions, Illinois lawmakers gathered for the 104th General Assembly inauguration on January 8. The recent session, however, faced criticism for not addressing pressing economic challenges affecting many residents. Instead, Governor Pritzker and his allies were accused of prioritizing legislation that favors noncitizens and criminals.
A notable piece of legislation passed during this session was House Bill 5164, known as the "Name Change Bill." It was approved by the Senate without Republican support on January 5 and subsequently passed in the House on January 7 along partisan lines. Supporters of the bill argue it provides an expedited and confidential process for noncitizens to change their names if they have resided in Illinois for at least three months. Critics are concerned that the bill's requirements are insufficient, allowing individuals to exploit the system without proof of eligibility.
The bill also permits judges to seal name change records, which opponents argue could create a loophole that undermines legal processes and may be exploited by those with malicious intent. They believe this measure exacerbates issues related to illegal immigration under Governor JB Pritzker’s administration, potentially compromising community safety.
In response to concerns about voter registration practices involving noncitizens, Senate Republicans are introducing new legislation aimed at safeguarding election integrity in Illinois. An immigrant rights advocate informed a Republican Senator from Litchfield that the Illinois Department of Human Services (DHS) is sending voter registration forms to noncitizens applying for state aid. These forms are included in packets addressed to local county clerks' offices.
Concerns have been raised that recipients might feel compelled to complete all forms despite language barriers, leading to potential voter fraud. Complicating matters further is recent legislation signed by Governor Pritzker allowing noncitizens to receive driver's licenses identical to those issued to citizens. County clerks currently lack means to verify citizenship based solely on these licenses.
Existing legislation from 2017 authorizes DHS to use aid applications for dual purposes, including voter registration verification before reaching county election officials. However, current law does not permit paper applications sent directly from applicants to county clerks who cannot verify citizenship status.
If noncitizens mistakenly register or vote, it could jeopardize election legitimacy and result in criminal charges impacting their path to citizenship. Proposed legislation aims to establish a database managed by the Illinois Secretary of State’s office listing all noncitizen driver’s license holders, enabling County Clerks to confirm voting eligibility.
In other news, Senator Don DeWitte has announced his fifth annual "Valentines for Seniors" card drive in the 33rd District. The initiative aims to combat loneliness among seniors by collecting cards and drawings until February 7 at district offices in West Dundee and St. Charles. Senator DeWitte's office will distribute them during Valentine’s Day week.
