Ald. Chanzit read aloud the Consent Agenda.
Motion by Ald. Chanzit, seconded by Ald. Solfa, to approve the consent agenda. Motion carried 13 yea/ 0 nay/ 1 absent.
7. MATTERS FROM THE PUBLIC: (For Items NOT On The Agenda)
Brian Panozzo from Riverside Pizza and Pub rose to address the council on changes to his business plan that would involve expansion of the business to incorporate a party room and overflow bar. Panozzo offered details on the concept and some of the plans he is considering to expand capacity to better serve his patrons.
Ald. Ajazi asked if there would be additional signage. Panozzo indicated that it would be titled Overflow. Services would be provided by the kitchen and staff of Riverside, but would operate as a party space for reservation or drop-in patrons.
Ald. Chanzit indicated that he has concerns about adequate supervision of the space. Panozzo said he takes his business very seriously and is confident in his plan.
Ald. Lanci commented that he is glad to see Riverside expanding.
Ald. Malay asked what the capacity would be. Panozzo responded that 70 would be the cap, but his preference would be 40-45. Ald. Malay also asked about build out costs to expand into this space. Panozzo responded that because of preexisting infrastructure, the costs to build out would be much more reasonable. Ald. Malay asked if the business model is viable without the addition of video gaming. Panosso responded that it would not be viable without the addition of video gaming.
Ald. Pieper asked if it were possible to remove the gaming machines from the current establishment to the Overflow space in order to control the proliferation of the machines. Pieper
Ald. Chanzit said it seemed clear that the Overflow business is a subsidiary of Riverside and that adding machines to Overflow would not create a new business with gaming machines, but rather expand the machines currently covered under Riverside’s license.
Ald. Malay noted that since this is an expansion of the business, not a new business, the regulation limiting the gaming machine license to 5 would apply.
Ald. Beck asked Administrator Newman for historical context on the establishment of the number of gaming licenses. Newman responded that the council at the time followed Illinois statute and when Illinois changed the limits on machines from 5 to 6, Council elected to keep the number stable rather than expand to 6.
Ald. Vogelsinger arrived at 7:10 pm.
8. PROCLAMATION: Foreign Exchange Students AFS-USA & EF
Mayor Schielke read aloud the proclamation. He invited Robin Lang to address the council and introduce the exchange students. Each student was presented with a copy of John Gustafson’s Historic Batavia signed by Mayor Schielke.
Motion by Ald. Solfa, seconded by Ald. Malay, to approve the proclamation. Motion carried 14 yea/ 0 nay/ 0 absent.
9. PROCLAMATION: Batavia Flag Day Monument Day October 1st 2023
Ald. Chanzit read aloud the presentation. Mayor Schielke encouraged the Council and audience to attend the celebration on October 1st.

10. PRESENTATION: Batavia Peace Day – Britta McKenna
Mayor Schielke introduced Britta McKenna who presented information on the upcoming Batavia Peace Day event on September 21st, 2023.
Mayor Schielke encouraged the Council and audience to attend the celebration on September 21st. No formal proclamation was made or approved.
11. MAINSTREET MINUTE
Beth Walker addressed the Council about the recent and upcoming activities of Batavia MainStreet. She mentioned that the indoor market will be opening and moving into Grainology at 131 Flynn Street, Suite C
She invited Joe Hunt from the Batavia Food Pantry and announced the results of the fundraising efforts at the Community Dinner Table event which raised over $6,300.
12. APPROVAL: To Waive Formal Bidding And Award A Contract For Water Treatment Iron Lagoon Cleaning To Steward Spreading
Ald. Cerone presented the request to waive formal bidding. Only one company is available to provide this service.
Motion by Ald. Cerone, seconded by Ald. Wolf , to waive formal bidding. Motion carried 14 yea/ 0 nay/ 0 absent.
13. RESOLUTION 23-109-R: Authorizing Execution Of Contract For Water Treatment Iron Lagoon Cleaning With Stewart Spreading For An Amount Not To Exceed $115,000.00 (JPB 08/22/2023 COW 9/12/23 11/0) PU

14. ADMINISTRATOR'S REPORT
Administrator Newman delivered her report. She presented an update on the Council directive to reallocate COVID funds to fund scholarships for the Fox Valley Entrepreneur Center. FVEC will match the allocated funds and four scholarships will be available for Batavia business owners next year. Please review recordings for comments in full.
Ald. Leman asked about the timeline rerouting of the bike path at Union and Water Street. She raised that she would like to see a discussion item about safety for increased bike traffic at an upcoming Committee of the Whole Meeting.

16. MAYOR’S REPORT
Mayor Schielke delivered his report. He spoke about a recent meeting he attended of a committee of mayors and the newly elected Mayor of Chicago. Please view the recording for comments in full.
