City of Batavia City Council met April 18.

1. MEETING CALLED TO ORDER

The Mayor called the meeting to order at 7:30 PM.

2. INVOCATION followed by PLEDGE OF ALLEGIANCE

Alderman Cerone led the Pledge of Allegiance.

Ald. Beck read aloud the Consent agenda.

Motion by Ald. Beck, seconded by Ald. Connelly, to approve the consent agenda. Motion carried 10 yea/ 0 nay/ 3 absent.

7. MATTERS FROM THE PUBLIC: (For Items NOT on the Agenda)

8. PUBLIC HEARING: Establishing Special Service Area Number 67 Kirkland Chase Phase Three Subdivision, Wind Energy Pass & Wagner Road

Mayor Schielke opened the public meeting at 7:35.

Two gentlemen residing at Wind Energy Pass asked for further information on the agenda item.

Batavia Community and Economic Development Coordinator Scott Buening addressed the questions.

Discussion ensued as to the possibility of a tax levy associated with the SSA. As a backup there is a $0.50/$100 EAV levy to care for the maintenance of three retention ponds. This levy would only levy the actual maintenance costs for the area.

Residents expressed concern that the single family home owners would be financially responsible for maintenance of retention ponds not owned or maintained by the homeowners association where the single family homes belong.

Buening responded that the drainage from the single-family homes is partly handled by the retention ponds in question. Though the single-family homes are not currently financially responsible for maintenance, in the unusual circumstance that the SSA would need to be applied, they would bear some financial responsibility.

Motion by Ald. Wolf , seconded by Ald. Beck, to close the public hearing at 7:46 PM. Motion carried 11 yea/ 0 nay/3 absent.

9. OATH OF OFFICE: Probationary Police Officer Travis Kurtz Mayor Schielke administered the Oath of Office to Police Officer Travis Kurtz.

10. RE-APPOINTMENT: Dennis Anderson To The Board Of Fire And Police Commission

Motion by Ald. Wolf , seconded by Ald. Cerone, to approve the appointment. Motion carried 11 yea/ 0 nay/3 absent.

11. PROCLAMATION: Arbor Day

Alderman Beck read the proclamation aloud. Mayor Schielke presented Gary Holm with the Proclamation in recognition of his leadership with the City to attain the Tree City USA designation.

Motion by Ald. Beck, seconded by Ald. Leman, to approve the proclamation. Motion carried 11 yea/ 0 nay/3 absent.

12. MAINSTREET MINUTE

Director Beth Walker delivered her report on the recent and upcoming programs of Batavia MainStreet.

She introduced four former Boardwalk Shop vendors who have now opened brick and mortar locations who discussed their experiences at the Boardwalk Shops. Meli Bernas, Pretty Pages; Abby Estes, Catalpa Manor; Jo Colagiacomi, New Moon Vegan; Cortney Kinzler, Black Angel Designs.

Motion by Ald. Wolf , seconded by Ald. Solfa, to approve the ordinance. Motion carried 11 yea/ 0 nay/3 absent.

14. DISCUSSION: 2021 West Side Property Maintenance Contract Renewal With Shamrock Hardscapes & Restoration, Inc. (SH 4/13/22) CS

Motion by Ald. Wolf , seconded by Ald. Cerone, to table discussion until the regular Committee of the Whole meeting on April 26th. Motion carried 11 yea/ 0 nay/3 absent.

Motion by Ald. Wolf , seconded by Ald. Cerone, to enter an executive session to discuss personnel issues in accordance with the Open Meetings Act, Section 2(c)(1). Motion carried 11 yea/ 0 nay/ 3 absent.

The executive session began at 8:35 pm and ended at 10:32 pm.

20. ADJOURNMENT

Motion by Ald. Wolf , seconded by Ald. Russotto, to adjourn. Motion carried by voice vote. The meeting adjourned at 10:34 p.m.
