Here is the minutes provided by the council:

The regular meeting of the Council of the City of Elgin, Illinois, was held in  the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:15 p.m. The  Pledge of Allegiance was led by Councilmember Rose Martinez. 

ROLL CALL 

Roll call was answered by Councilmembers Dixon, Gavin, Lopez, Martinez, Powell,  Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None. All members, with the  exception of Councilmembers Martinez, Shaw and Mayor Kaptain, attended via electronic  means. This was allowed at this time granted by Governor Pritzker’s Executive Order 2020-07. 

MINUTES OF THE FEBRUARY 24, 2021, COUNCIL MEETING APPROVED AS  DISTRIBUTED 

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve the February 24, 2021, regular council meeting minutes as distributed. Upon a roll call vote: Yeas:  Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and  Mayor Kaptain. Nays: None. 

PUBLIC COMMENTS 

Darlene Castelvecchi concerns about the zoning case at 310 S. State Street that would call for a  crematory and parking lot expansion at Laird Funeral Home. She stated concerns regarding  notice to the neighborhood and emissions. 

Brenda Rodgers stated her concerns about alleged ethics violations by Councilmember Dixon. 

Chris Kious, Kane County Board Member for the 23rd District, introduced himself and stated he  looked forward to working with the city.

BID 21-003 AWARDED TO WESTERN SPECIALTY CONTRACTORS FOR THE  SPRING STREET PARKING STRUCTURE CONCRETE AND MAINTENANCE REPAIRS 

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to award a  contract to Western Specialty Contractors in the amount of $178,823 to perform necessary  concrete repairs, expansion joint replacements and other maintenance repairs to the City owned  Spring Street parking structure to properly maintain the property. Upon a roll call vote: Yeas:  Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and  Mayor Kaptain. Nays: None.  

SOURCEWELL COOPERATIVE AGREEMENT APPROVED WITH KONICA  MINOLTA BUSINESS SOLUTIONS FOR THE LEASE OF SEVEN DIGITAL COPIERS 

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve a  contract with Konica Minolta Business Solutions in the amount of $71,956 for three years for the  lease of six black and white and one color multi-functional devices to expedite services, increase  efficiencies and provide devices which are an essential component of the City’s efforts to create  a sustainable records management program. Upon a roll call vote: Yeas: Councilmembers  Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain.  Nays: None. 

RESOLUTION 21-38 ADOPTED APPROVING FINAL PLAT OF SUBDIVISION OF  BOWES CREEK COUNTRY CLUB PHASE 4C SUBDIVISION 

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to adopt the  following resolution. Upon a roll call vote: Yeas: Councilmembers Gavin, Lopez, Martinez,  Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. Councilmember  Dixon abstained.

AUTHORIZING EXECUTION OF AN AGREEMENT WITH KEARNS & WEST, INC. FOR  PROFESSIONAL SERVICES IN CONNECTION WITH GROUP FACILITATION FOR THE  COMMUNITY TASK FORCE ON POLICING 

BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,  ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are  hereby authorized and directed to execute an Agreement on behalf of the City of Elgin with Kearns  & West, Inc., for professional services in connection with group facilitation for the community  task force on policing, in such form as approved by the Corporation Counsel.

AN ORDINANCE 

AMENDING SECTION 11.60.066 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED “LIMITED PARKING AREAS; RESTRICTIONS ON ODD AND EVEN NUMBERED DAYS” 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: 

Section 1. That Section 11.60.066 of the Elgin Municipal Code, 1976, as amended, entitled  “Limited Parking Areas; Restrictions on Odd and Even Numbered Days” be and is hereby further  amended by amending subparagraph B subsection 1 thereof to read as follows: 

"1. Area 1—Southwest Area Neighbors: Those streets located within the area bounded by  the south line of Walnut Avenue and National Street on the north, the western edge of the  Fox River on the east, the north line of U.S. Highway 20 on the south, and the west line of  Gertrude Street on the west, with the exception of Lindbergh Court, the portion of Ryerson  Avenue located north of Washburn Street, and the portion of Washburn Street between 

South State Street and Ryerson Avenue. The parking restrictions of subparagraph A of this  section shall not be enforced on Sundays on the following streets: Griswold Street between  Walnut Avenue to Washburn; and Washburn Street between Billings Street and Griswold  Street." 

Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this  ordinance be and are hereby repealed to the extent of any such conflict. 

Section 3. That this ordinance shall be in full force and effect upon its passage and  publication in the manner provided by law.

AN ORDINANCE  

GRANTING A CONDITIONAL USE FOR A PLANNED DEVELOPMENT IN THE NB  NEIGHBORHOOD BUSINESS DISTRICT AND ARC ARTERIAL ROAD CORRIDOR  OVERLAY DISTRICT WITH CERTAIN DEPARTURES FROM THE ELGIN ZONING  ORDINANCE 

(310 South State Street) 

WHEREAS, written application has been made requesting conditional use approval for a  planned development to construct a 1,500-square foot addition to establish a crematory as part of  the existing funeral service and to construct a parking lot expansion with certain departures from  the Elgin zoning ordinance at 310 South State Street; and 

WHEREAS, the zoning lot containing the premises at 310 South State Street is legally  described herein (the “Subject Property”); and 

WHEREAS, by adopting Ordinance No. G45-92 (herein after “Elgin Zoning Ordinance”),  the City Council of the City of Elgin, Illinois (hereinafter “the City Council”) classified the Subject  Property in the NB Neighborhood Business District; and 

WHEREAS, by adopting Ordinance No. G37-01, the City Council also classified the  Subject Property in the ARC Arterial Road Corridor Overlay District; and 

WHEREAS, Funeral Service (726) is listed as a Conditional Use in the NB Neighborhood  Business District; and 

WHEREAS, the existing funeral service on the Subject Property was established prior to  the adoption of the Elgin Zoning Ordinance; and  

WHEREAS, per Section 19.05.500 Transition Rules, of the Elgin Zoning Ordinance, the  existing funeral service use is deemed a lawful existing conditional use; and  

WHEREAS, the Planning and Zoning Commission conducted a public hearing concerning  said application on February 1, 2021, following due notice including by publication; and

WHEREAS, the Community Development Department and the Planning and Zoning  Commission have submitted their Findings of Fact concerning said application; and 

WHEREAS, the Community Development Department and the Planning and Zoning  Commission recommend approval of said application, subject to the conditions articulated below;  and 

WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and  recommendations of the Community Development Department and the Planning and Zoning  Commission; and 

WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any  power and perform any function pertaining to its government and affairs; and 

WHEREAS, zoning, including, but not limited to, this ordinance granting a conditional use  for a planned development in the NB Neighborhood Business District pertains to the government  and affairs of the city. 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF  ELGIN, ILLINOIS: 

Section 1. That the City Council of the City of Elgin hereby adopts the Findings of  Fact, dated February 1, 2021, and the recommendations made by the Community Development  Department and the Planning and Zoning Commission, a copy of which is attached hereto and  made a part hereof by reference as Exhibit A. 

Section 2. That a conditional use for a planned development to construct a 1,500- square foot addition to establish a crematory as part of the existing funeral service and to construct  a parking lot expansion with certain departures from the Elgin zoning ordinance is hereby granted  for the property commonly known as 310 South State Street, and commonly identified by Kane  County Property Index Numbers 06-23-232-013, 06-23-232-014, 06-23-232-015, 06-23-232-016,  and 06-23-232-017, and legally described as follows:

Section 3. That the conditional use for a planned development for the Subject Property  as authorized by this ordinance shall be subject to the following additional conditions: 

1. Substantial conformance to the Development Application submitted by Laird Building  Partnership, an Illinois General Partnership composed of Stephen Laird and Robert  Laird, as applicant and property owner, received June 29, 2020, and supporting  documents including: 

a. Rider Statement of Purpose and Conformance for Conditional Use, received  December 17, 2020; 

b. Plat of Survey, prepared by Alan J. Coulson, P.C., dated April 29, 2019; c. Architectural plans, including sheets Pr1, LS1, and EX1, prepared by Gilmore,  dated January 6, 2021, with such further revisions as required by the Community  Development Director; 

d. A one-page letter from Matthews’ Environmental Solutions, dated June 15, 2020;  and  

e. A two-page letter from Matthews’ Environmental Solutions, dated June 15, 2020. 

In the event of any conflict between such documents and the terms of this ordinance or  other applicable city ordinances, the terms of this ordinance or other applicable city  ordinances shall supersede and control.

2. A departure is hereby granted to allow the construction of the building addition with a  minimum building interior yard setback of 4.3 feet from the west property line. 

3. A departure is hereby granted to allow the construction of the parking lot expansion  with a minimum vehicle use area interior yard setback of two feet from the south  property line. 

4. A departure is hereby granted to allow the construction of the parking lot expansion  with a minimum vehicle use area street yard setback of 6.8 feet from the east property  line. 

5. A departure is hereby granted to allow the construction of the refuse collection area  enclosure with a minimum interior yard setback of one foot from the west property line.  

6. The proposed crematory shall operate in compliance with all applicable governmental  regulations. 

7. Compliance with all applicable codes and ordinances. 

Section 4. That this ordinance shall be in full force and effect upon its passage in the  manner provided by law.

AN ORDINANCE  

GRANTING A CONDITIONAL USE FOR A PLANNED DEVELOPMENT IN THE CC2  CENTER CITY DISTRICT WITH CERTAIN DEPARTURES FROM THE ELGIN ZONING  ORDINANCE 

(151 North Spring Street) 

WHEREAS, written application has been made requesting conditional use approval for a  planned development to construct a 300-square foot addition to the existing building with certain  departures from the Elgin zoning ordinance at 151 North Spring Street; and 

WHEREAS, the zoning lot containing the premises at 151 North Spring Street is legally  described herein (the “Subject Property”); and 

WHEREAS, the Subject Property is located within the CC2 Center City District; and 

WHEREAS, the Planning and Zoning Commission conducted a public hearing concerning  said application on February 1, 2021, following due notice including by publication; and 

WHEREAS, the Community Development Department and the Planning and Zoning  Commission have submitted their Findings of Fact concerning said application; and 

WHEREAS, the Community Development Department and the Planning and Zoning  Commission recommend approval of said application, subject to the conditions articulated below;  and 

WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and  recommendations of the Community Development Department and the Planning and Zoning  Commission; and 

WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any  power and perform any function pertaining to its government and affairs; and 

WHEREAS, zoning, including, but not limited to, this ordinance granting a conditional use  in the CC2 Center City District pertains to the government and affairs of the city.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF  ELGIN, ILLINOIS: 

Section 1. That the City Council of the City of Elgin hereby adopts the Findings of  Fact, dated February 1, 2021, and the recommendations made by the Community Development  Department and the Planning and Zoning Commission, a copy of which is attached hereto and  made a part hereof by reference as Exhibit A. 

Section 2. That a conditional use for a planned development to construct a 300-square  foot addition to the existing building with certain departures from the Elgin zoning ordinance is  hereby granted for the property commonly known as 151 N. Spring Street, and commonly  identified by Kane County Property Index Number 06-13-151-006, and legally described as  follows: 

Lot One, (1) in Block Four, (4), in S. Newton’s Addition to Elgin, in the City of Elgin,  Kane County, Illinois (commonly known as 151 N. Spring Street). 

Section 3. That the conditional use for the Subject Property as authorized by this  ordinance shall be subject to the following additional conditions: 

8. Substantial conformance to the Development Application submitted by Spruce and  Main Properties LLC, as applicant and property owner, received October 22, 2020, and  supporting documents including: 

a. Conditional Use-Statement of Purpose and Conformance letter, prepared by Red  Line Architects, Ltd., dated January 5, 2021; 

b. Plat of Survey, prepared by Alan J. Coulson, P.C., dated March 13, 2017; 

c. A seven-page architectural plan set, including Zoning and Scope, Site Plan,  Landscape Plan, Building Plan, Elevations, Color Rendering and Proposed  Materials, and Signage and Proposed Materials sheets, prepared by Red Line  Architects, Ltd., dated January 5, 2021, with such further revisions as required by  the Community Development Director; and 

d. Electrical Site Plan, prepared by RTM Engineering Consultants, dated January 5,  2021, with such further revisions as required by the Community Development  Director. 

In the event of any conflict between such documents and the terms of this ordinance or  other applicable city ordinances, the terms of this ordinance or other applicable city  ordinances shall supersede and control.

9. A departure is hereby granted to allow the construction of the building addition with a  street yard setback of 25 feet from the west property line and 49.75 feet from the south  property line. 

10. A departure is hereby granted to allow the construction of the building addition with  minimum 40% (3,298 square feet) building coverage. 

11. A departure is hereby granted to allow the construction of a refuse collection area with  six-foot high non-masonry steel panels. 

12. A departure is hereby granted to allow the construction of ground floor storefront  windows with semi-transparent, gray-tinted glazing. 

13. A departure is hereby grated to allow the construction of site lighting with a minimum  light reading on pavement of 0.045 foot candles, and average to minimum site lighting  uniformity ratio of 34.19. 

14. The existing free-standing pylon sign shall be removed with the construction of the  proposed building addition. 

15. The motor vehicle repair shop employees shall park personal vehicles at the City of  Elgin Center Parking Structure or other municipal parking facility. 

16. Compliance with all applicable codes and ordinances. 

Section 4. That this ordinance shall be in full force and effect upon its passage in the  manner provided by law.

WHEREAS, the levy of the tax for the year 2020 provided in the ordinance is unnecessary.

Section 1. WHEREAS, the City of Elgin will have sufficient funds on hand to pay a portion of the tax  levied by Ordinance S1-16, An Ordinance Providing for the Issuance of $24,995,000 General  Obligation Corporate Purpose Bonds, Series 2016, of the City of Elgin, Kane and Cook Counties,  Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the  Principal of and Interest on said Bonds; and 

WHEREAS, the levy of the tax for the year 2020 provided in the ordinance is unnecessary. 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF  ELGIN, ILLINOIS: 

Section 1. That the County Clerks of Kane and Cook Counties, are hereby authorized  and directed to abate a portion of the tax of $1,904,800 for the year 2020 as provided and levied  in the ordinance providing for the issuance of $24,995,000 General Obligation Corporate Purpose Bonds, Series 2016, passed February 10, 2016, a copy of which was filed with each of said county  clerks, said tax shall be abated by reducing said sum $830,600 and extending a tax for the year  2020 in the amount of $1,074,200 against all taxable property situated in the City of Elgin, Kane  and Cook Counties, Illinois. 

Section 2. That the City Clerk is authorized and directed to file a certified copy of this  ordinance with the County Clerks of Kane and Cook Counties, Illinois, prior to March 15, 2021. 

Section 3. That this ordinance shall be in full force and effect from and after its passage  in the manner provided by law.

WHEREAS, the levy of the tax for the year 2020 provided in the ordinance is unnecessary. 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF  ELGIN, ILLINOIS: 

Section 1. That the County Clerks of Kane and Cook Counties, are hereby authorized  and directed to abate the tax of $794,250 for the year 2020 as provided and levied in the ordinance  providing for the issuance of $9,000,000 General Obligation Corporate Purpose Bonds, Series  2019, passed March 20, 2019, a copy of which was filed with each of said county clerks. 

Section 2. That the City Clerk is authorized and directed to file a certified copy of this  ordinance with the County Clerks of Kane and Cook Counties, Illinois, prior to March 15, 2021. 

Section 3. That this ordinance shall be in full force and effect from and after its passage  in the manner provided by law.

WHEREAS, the levy of the tax for the year 2020 provided in the ordinance is unnecessary. 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF  ELGIN, ILLINOIS: 

Section 1. That the County Clerks of Kane and Cook Counties are hereby authorized and  directed to abate a portion of the tax of $789,300 for the year 2020 as provided and levied in the  ordinance providing for the issuance of $8,990,000 General Obligation Refunding Bonds, Series  2020A, passed November 20, 2019, a copy of which was filed with each of said county clerks;  said tax shall be abated by reducing said sum $752,850 and extending a tax for the year 2020 in  the amount of $36,450 against all taxable property situated in the City of Elgin, Kane and Cook  Counties, Illinois.

Section 2. That the City Clerk is authorized and directed to file a certified copy of this  ordinance with the County Clerks of Kane and Cook Counties, Illinois, on or before March 15,  2021. 

Section 3. That this ordinance shall be in full force and effect from and after its passage  in the manner provided by law.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF  ELGIN, ILLINOIS: 

Section 1. Ordinance No. G15-21 

AN ORDINANCE  

AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED,  ENTITLED "ALCOHOLIC LIQUOR DEALERS" TO AMEND THE NUMBER OF CERTAIN  AVAILABLE LIQUOR LICENSE CLASSIFICATIONS  

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF  ELGIN, ILLINOIS: 

Section 1. That Section 6.06.050 of the Elgin Municipal Code, 1976, as amended,  entitled "Licenses; Number to be Issued:" be and is hereby further amended by amending  subparagraphs A, G, L, M, P, S, and W thereof to read as follows: 

"A. The number of Class A licenses shall not exceed nine (9) in number. G. The number of Class B-4 licenses shall not exceed six (6) in number. L. The number of Class E licenses shall not exceed eleven (11) in number. M. The number of Class E-1 licenses shall not exceed five (5) in number. P. The number of Class F licenses shall not exceed eight (8) in number. S. The number of Class M licenses shall not exceed one (1) in number. W. The number of Class R licenses shall not exceed zero (0) in number." 

Section 2. That Section 6.06.056 of the Elgin Municipal Code, 1976, as amended,  entitled "Young Adult Night Permit:" be and is hereby repealed. 

Section 3. That Section 6.06.057 of the Elgin Municipal Code, 1976, as amended,  entitled "Teen Night Permit:" be and is hereby repealed. 

Section 4. That all ordinances or parts of ordinance in conflict with the provisions of  this ordinance are hereby repealed to the extent of any such conflict. 

Section 5. That this ordinance shall be in full force upon its passage and publication in  the manner provided by law.
