City of Elgin City Council Met Dec. 2.

Here is the minutes provided by the council:

The regular meeting of the Council of the City of Elgin, Illinois, was held in the Council Chambers. The meeting was called to order by Mayor Kaptain at 7:15 p.m. The Pledge of Allegiance was led by City Manager Rick Kozal.

ROLL CALL

Roll call was answered by Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Absent: None. All members, with the exception of Mayor Kaptain, attended via electronic means. This was allowed at this time granted by Governor Pritzker’s Executive Order 2020-07.

MINUTES OF THE NOVEMBER 18, 2020, COUNCIL MEETING APPROVED AS DISTRIBUTED

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve the November 18, 2020, Council Meeting Minutes as distributed. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

PURCHASE OF FORTY AUTOMATED EXTERNAL DEFIBRILLATORS AND VARIOUS EQUIPMENT FROM SECOND CHANCE CARDIAC SOLUTIONS APPROVED UTILIZING THE NATIONAL PURCHASING PARTNERS PROGRAM

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve and ratify the purchase of 40 automated external defibrillator devices, four AED training units, four back up battery packs and six replacement pads from Second Chance Cardiac Solutions utilizing National Purchasing Partners pricing in the amount of $59,956. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

NATIONAL COOPERATIVE PURCHASING ALLIANCE APPROVED WITH F.H. PASCHEN FOR A FLEET SERVICES VEHICLE EXHAUST REMOVAL AND VENTILATION SYSTEM UPGRADE

Councilmember Dixon made a motion, seconded by Councilmember Steffen, to approve a contract with F.H. Paschen in the amount of $145,884 to make building improvements to the public works fleet service center to ensure efficient and safe maintenance of City vehicles and equipment by upgrading the overhead ventilation system. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

PETITION 25-20 APPROVED FOR 3600 BOWES ROAD; FINAL PLAT OF SUBDIVISION FOR BOWES CREEK COUNTRY CLUB SUBDIVISION PHASE 4C

Marc Mylott, Community Development Director, outlined Petition 25-20 for 3600 Bowes Road. The petition allows for approval of the final plat of subdivision for Bowes Creek County Club Subdivision Phase 4C. Staff and the Planning and Zoning Commission recommend approval subject to the conditions outlined.

Councilmember Shaw made a motion, seconded by Councilmember Martinez, to approve Petition 25-20 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None. Councilmember Dixon abstained.

PETITIONS 26-20 AND 27-20 APPROVED FOR 302 W. CHICAGO STREET; MAP AMENDMENT FROM RC3 RESIDENCE CONSERVATION DISTRICT TO CC2 CENTER CITY DISTRICT, AND PLANNED DEVELOPMENT AS A CONDITIONAL USE FOR ADAPTIVE REUSE OF NANCY KIMBALL HOUSE AS AN EVENT SPACE WITH CONSTRUCTION OF AN ACCESSORY PARKING LOT

Marc Mylott, Community Development Director, outlined Petition 26-20 and 27-20 for 302 W. Chicago Street. The petition allows for a map amendment and a planned development as a conditional use for adaptive reuse to allow an event space with an accessory parking lot. Staff and the Planning and Zoning Commission recommend approval subject to the conditions outlined.

Councilmember Gavin made a motion, seconded by Councilmember Martinez, to approve Petitions 26-20 and 27-20 subject to conditions. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

PUBLIC HEARING FOR THE 2021 PROPOSED CITY OF ELGIN BUDGET Mayor Kaptain declared the public hearing open.

There was discussion surrounding the proposed positions and duties of the Sustainability Coordinator and Human Rights and Equity Officer. Questions were raised regarding the appropriate timing adding the positions to the city. Concerns were raised regarding the costs associated with the positions and the city’s overall financial position.

Mayor Kaptain read public comment emails from Sherry Liske and Kevin Zaldivar.

Ms. Liske stated her concerns regarding the increased funding requests from the Police Department.

Mr. Zaldivar stated his concerns over the lack of funding to support the Climate Action Plan. Mayor Kaptain declared the public hearing closed.

Councilmember Shaw made a motion, seconded by Councilmember Gavin, to utilize the surplus of $5.4 million in the 2020 budget to prefund the public safety pension obligation of 2021. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

PUBLIC HEARING ON RENAMING THE "FARM ZOO" IN THE LORDS PARK ZOO TO "TEFFT'S FARM"

Mayor Kaptain declared the public hearing open. There were no comments submitted to be read on the subject and no comments from those present. The public hearing was closed.

CONSENT AGENDA

By unanimous consent, Councilmember Powell made a motion, seconded by Councilmember Martinez, to adopt Resolution Nos. 20-155 through 20-159 by omnibus vote. Upon a roll call vote: Yeas: Councilmembers Dixon, Gavin, Lopez, Martinez, Powell, Rauschenberger, Shaw, Steffen, and Mayor Kaptain. Nays: None.

RESOLUTION 20-155 ADOPTED AUTHORIZING EXECUTION OF AMENDMENT AGREEMENT NO. 2 WITH BAXTER & WOODMAN, INC. FOR SUPPLEMENTAL PROFESSIONAL ENGINEERING SERVICES IN CONNECTION WITH THE DUNDEE AVENUE AND SUMMIT STREET INTERSECTION IMPROVEMENT PROJECT

RESOLUTION

AUTHORIZING EXECUTION OF AMENDMENT AGREEMENT NO. 2 WITH BAXTER & WOODMAN, INC. FOR SUPPLEMENTAL PROFESSIONAL ENGINEERING SERVICES IN CONNECTION WITH THE DUNDEE AVENUE AND SUMMIT STREET INTERSECTION IMPROVEMENT PROJECT

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that an exception to the requirements of the procurement ordinance is necessary and in the best interest of the city; and

BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute an Amendment Agreement No. 2 on behalf of the City of Elgin with Baxter & Woodman, Inc. for supplemental professional engineering services in connection with the Dundee Avenue and Summit Street Intersection Improvement Project, a copy of which is attached hereto and made a part hereof by reference.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Atziri Reyes is hereby appointed as a Student Representative member of the Human Relations Commission, for a term that will expire on August 31, 2021.

BE IT FURTHER RESOLVED that the proposed settlement of the pending workers' compensation case of Clay Potvin, Case No. 19 WC 33634, in the total amount of $31,480.46 is approved.

BE IT FURTHER RESOLVED that the proposed settlement of the pending workers' compensation case of Craig Arnold, Case No. 20 WC 5087, in the total amount of $81,387.00 is approved.

AUTHORIZING EXECUTION OF A 2020 AGREEMENT WITH THE KANE COUNTY CHILD ADVOCACY CENTER FOR FUNDING ASSISTANCE RELATING TO THE INVESTIGATION OF SENSITIVE CRIMES INVOLVING CHILDREN

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute a 2020 Agreement on behalf of the City of Elgin with the Kane County Child Advocacy Center by and through the Kane County State’s Attorney, for funding assistance relating to the investigation of sensitive crimes involving children, a copy of which is attached hereto and made a part hereof by reference.

BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Resolution No. 20-112 adopted on August 26, 2020, providing for the execution of an agreement with the Kane County Child Advocacy Center, be and is hereby repealed.

Kaptain, Mayor, be and is hereby authorized and directed to execute a local agency agreement for federal participation on behalf of the City of Elgin with the Illinois Department of Transportation in connection with the Mclean and Big Timber Road Railroad Signal Improvements Project, Section Number 14-00185-00-TL, Job Number C-91-372-14, Project Number RRP-4003(352), a copy of which is attached hereto and made a part hereof by reference.
