Village of South Elgin Committee of the Whole met Nov. 4.

Here is the minutes provided by the committee:

1. OPENING CEREMONY

A. Call to Order

The November 4, 2019 Committee of the Whole Meeting was called to order at 7 pm by Village President, Steve Ward, at South Elgin Village hall, 10 N. Water Street, South Elgin, IL.

B. Roll Call

The following were present: Steven Ward, Village President, Margaret Gray, Village Clerk and Trustees: Lisa Guess, Greg Lieser, John Sweet, Jennifer Barconi, Scott Richmond and Mike Kolodziej.

Also present: Steve Super, Village Administrator; Megan Golden, Director of Administrative Services; Nancy Hill, Director of Community Development; Jerry Krawczyk, Police Chief; Kim Wascher, Director of Parks & Recreation, Mike Millette, Director of Public Works and Derke Price, Attorney.

2. CLOSED SESSION

There was no Closed Session held.

3. DISCUSSION

A. Discussion: Police Pension Fund Actuarial Report for the Tax Levy Year 2019 for Property Taxes in 2020, Lauterbach & Amen

Todd Schroeder of Lauderbach and Amen presented a brief overview of the report and explained that benefit payments will double in the next five years and even more in ten years. Trustee Richmond asked about adding money to make up the lack of return on investments-planned on 7%, but actually were 5.75%. Todd said they will suggest that the amount of return be lowered to meet current expectations. Steve Super asked about proposed changes on police pension laws and how that would affect actuaries. Todd explained he has not read the proposed law. It will take to about 2023 to make full changes at which time there will be one actuary for police and another for fire pensions. Trustee Kolodziej asked why we should strive 100% funding. Todd explained that if fully funded the interest accrued would help pay benefits. In the long run it would reduce the amount required to be paid by the Village. President Ward suggested that the Village should look at lowering our expended earnings rate.

B. Discussion: Proposed Estimated 2019 Property Tax Levy and Abatements

C. Discussion: Proposed 2019 Tax Levy for Parkside Woods Special Service Area #2

D. Discussion: Proposed Text Amendment to the Unified Development for Cannabis Business Establishments

Trustee Richmond asked if a facility will allow samples. Nancy Hill answered that the state statute does not allow for free samples. Derke Price added that there is no consumption allowed in the store. President Ward asked where violators will be prosecuted. Selling under 21 will be handled by the State. State's Attorney will be far too busy to handle all violators and most likely will be seen at local adjudication hearings. Trustee Guess asked if churches should be included in distances from stores. Derke said that the state statute does not address churches. Trustee Richmond suggested that churches are somewhat covered by daycare and school in a church are regulated.

E. Discussion: Proposed Number of Cannabis Business Establishments to be Allowed in the Village of South Elgin

Nancy Hill suggested at one each of all the classifications be allowed by resolution. If additional retailers wish to be here, new resolutions could be passed as needed, similarly to how the number of liquor licenses are increased. Derke Price explained how these licenses might be handed out. Trustee Guess said that just the legalization will add police enforcement issues placing additional burden on the department. She feels that the number of calls will increase. She asked if we are going to get enough in tax money to deal with increased police costs. President Ward said that he does not feel the police departments will be overburdened.

F. Discussion: Proposed Municipal Cannabis Retailer's Occupation Tax

President Ward suggested that this tax money be used for controlling results of marijuana use in South Elgin and be used by the Police Department.

G. Discussion: 2019 Class A Liquor License - Roma Foodmart Inc., d/b/a Star Food & Liquor - 310 N. LaFox - #4

For clarification, this is the liquor store next door to the Post Office. It will have more convenience grocery items in the store and less liquor.

H. Discussion: Proposed Amendment to the Economic Incentive and Tax Increment Allocation Financing Development Agreement by and between the Village of South Elgin and SCG TMG Fox View South Elgin LLC (Panton Mill Station Apts)

President Ward said that it is a good decision in taking the developer out of the picture for the build of the Village bandshell.

4. CLOSING CEREMONY

Motion to adjourn the November 4, 2019 Committee of the Whole Meeting.

Motion by Trustee Barconi, second by Trustee Sweet.

Motion Carried
