CITY OF BATAVIA: The Recreational Cannabis Act – What You Need To Know

City of Batavia issued the following announcement on Jan. 4.

On January 1, 2020, the use of small amounts of marijuana and cannabis-infused products became legal for individuals 21 years of age and older in the State of Illinois. An Illinois resident age 21 years or older is now allowed to possess the following:

• 30 grams of raw cannabis flower;

• Cannabis-infused products containing up to 500 mg of THC;

• 5 grams of cannabis concentrate

• Out of state citizens age 21 and over can legally purchase and possess up to half the above-listed amounts

*No person under the age of 21 may purchase, use, possess, transport, grow or consume cannabis except where authorized by the Community College Cannabis Vocational Pilot Program.

The only lawful places to consume cannabis or cannabis-infused products are at a private residence, outside of public view, or at locations legally approved for on-site consumption of cannabis or cannabis-infused products. Currently, the City of Batavia has not approved any locations for on-site consumption, nor for cannabis sales. It is illegal to consume cannabis products or smoke cannabis in any public place.

It is also illegal to transport cannabis within a motor vehicle unless the cannabis is being carried inside a sealed, odor-proof and child resistant container and reasonably inaccessible to the driver. It remains illegal to use cannabis or cannabis-infused products inside a motor vehicle.

Driving under the influence of any drug and/or other intoxicating compound, including cannabis, remains illegal. We remind anyone who wishes to consume cannabis to use sound judgment and not drive while impaired or intoxicated.

We also encourage citizens to please be respectful of neighbors while ingesting cannabis or cannabis-infused products.
