1. The site has increased impervious over the past years and will require Stormwater Detention and BMPs for this impervious and proposed changes to the site. A Preliminary site plan has been submitted showing Detention and BMPs.

2. The applicant has submitted a site plan which includes proposed Stormwater Facilities. These plans reference a drainage easement for the outfall. Water Resources will require this drainage easement as part of the stormwater management for the site. This easement is not on the applicant’s property and is critical in the design of the proposed outfall.

3. The petitioner shall dedicate a 60-foot half right of way from centerline of Big Timber Road. Any intensification will require access to be moved through the existing access easement to the west, to Madeline Drive.

Zoning Board: Approval with the following stipulations:

1. All lots shall have access restricted to Getzelman Road. No Access shall be allowed to Lenschow Road.

2. In order to clearly communicate the triggers for Stormwater Detention, Water Resources recommends that, if approved for rezoning, a maximum impervious area of development be recorded as a note on the plat for each parcel.

3. The depth of a basement and height of the first floor for any new construction will be limited by the water table and the BFE, which includes the HWL of any Detention facilities.

4. Development as defined by the Kane County Stormwater Management Ordinance on parcels 01-33-400-010, 01-33- 400-011 and 01-33-400-013 (located at the Northwest corner of Getzelman Rd and Lenshcow Rd) that singularly results in greater than 5,000 sq ft of new impervious area, or cumulatively (as of Jan 1, 2002) results in greater than 25,000 sq ft of new impervious area shall provide Stormwater Management Measures as required by the Kane County Stormwater Ordinance. If the total new impervious exceeds 25,000 sq ft, all lot and parcel owners shall jointly cause the design, permitting and construction of a Detention Storage Facility and off-site outfall (if required) that will store and release runoff from the new impervious areas. The lot and parcel owners will develop and implement a maintenance plan for the Detention Storage Facility, record an easement over the Detention Storage Facility and establish a Special Service Area for said Detention Storage Facility (and off-site outfall – if required). The building permit for the Development that results in the exceedance of the 25,000 sq ft of new impervious area will not be released until a Stormwater Management Permit is issued for the Detention Storage Facility as outlined above. (Please note that the house and any impervious area existing prior to 2002 located on parcel 01-33-400-012 will not be considered towards the trigger for Stormwater Detention.)The applicant has submitted a site plan which includes proposed Stormwater Facilities. This easement is not on the applicant’s property and is critical in the design of the proposed outfall.

Zoning Board: Approval with the following stipulations:

1. The applicant will need to go through the Minor Subdivision process.

2. Stormwater issues will be addressed during the Subdivision process. Please note that any development within the subdivision that results in 5,000 sq ft of new impervious area will require BMPs. Any development that results in impervious area greater than 25,000 sq ft will require Stormwater Detention. (Please note that the house and any impervious area existing prior to 2002 located on the parcel currently identified as 11-32-301- 002 will not be considered towards the trigger for Stormwater Detention.)

3. In order to clearly communicate the triggers for Stormwater Detention, Water Resources recommends that a maximum impervious area of development be recorded on the subdivision plat for each parcel.

4. The depth of a basement and height of the first floor for any new construction will be limited by the water table and the BFE, which includes the HWL of any Detention facilities.

5. Right of way and highway easement must be dedicated in the total sum of 66 feet for Finley Road. It is suggested that 33 feet of right of way to the south should be dedicated, and a combination of right of way and highway easement, to allow the existing home to not be included in right of way to the north.
