2. Public Comment

Chair Kojzarek noted the petitioner for No. 4460 has requested the petition be tabled. Those signed up to speak on the petition may still speak or decline and hold comments until the September County Development Committee meeting.

Petition No. 4460 Speakers

Abel Partida Cuevos, neighboring property west of petitioner, spoke in opposition noting he has owned his property about 40 years. If the zoning goes through, his residence will be sandwiched between two businesses. He asked the Board to consider the impact it will have on the sale of his property.

James Ahng, nearby property owner, spoke in opposition with concerns over the wells affecting his property. He discussed ongoing problems with flooding in the area.

John Quinn, neighboring property adjacent to petitioner, spoke in opposition noting his family will see the proposed gravel plant from the front of their house. He shared his concerns over the noise from the trucks and gravel dust. Mr. Quinn provided several pictures of ongoing issues with flooding.

John Reyes, neighboring property adjacent to petitioner, spoke in opposition with concerns over the increase in traffic and noise on McClure Road. He discussed how the business would affect the future sale of his home. Mr. Reyes also shared ongoing problems with employees from the surrounding businesses throwing bottles into his yard.

Daniel Holbrook and Steve Fidler respectfully declined to speak until the September 18 meeting.

5. PETITION NO. 4461: Jose Ramirez

The petitioner is requesting a Five-year Interim Special Use for a landscaping business. There are no objectors. The ZBA voted to approve with the following stipulation: 1. The Interim Special Use be conditioned on the current owner retaining ownership of the property for the five years, or the Interim Special Use will terminate upon closing of property to another individual. Contingent to bringing the property in compliance with the Stormwater Ordinance.

Atty. John Doherty, representative for the petitioner, responded to questions. The property owner, Mr. Ramirez, is looking to retire and close down the business. When he initially purchased the home, he was not aware that he could not operate the business from the property. He has been running the business from the site for about 12 years. He will do what needs to be done and has agreed to the contingency. He has already relocated the business from the front of the buildings to bring it into compliance.

Conservation Authority NFP (IECA) to Provide Program Administration Services for the Proposed Kane Energy Efficiency Program (KEEP) as a "Property Assessed Clean Energy" Program for Kane County

This authorizes an agreement with the Illinois Energy Conservation Authority NFP to provide PACE administration program services at no cost to the County as amended to strike the wording requiring the attachment.

This authorizes the submission of the advisory question of public policy on the General Election November 6, 2018 ballot: “Should the Illinois General Assembly Amend The State Constitution To Ban The Implementation Of A 1% Property Tax Increase" as amended for the summary question be: "Shall Kane County Oppose the General Assembly Instituting a 1% Property Tax Increase to Help Retire State Debt?"
