Village of Montgomery Village Board met May 14.

Here is the minutes provided by the Board:

President Brolley called the meeting to order at 7:01 p.m. followed by the Pledge of Allegiance.

Roll Call:

Also present: Administrator Jeff Zoephel, Attorney Laura Julien, Chief of Police Phillip Smith, Deputy Chief of Police Armando Sanders, Director of Community Development Rich Young, Engineer Peter Wallers, Village Clerk Penny FitzPatrick, Members of the Press and others.

Public Participation:

A.Public Comments.

Residents Chad Davis and Sarah Klostermann of Shetland Lane shared concerns regarding the recent installation of a backyard chicken coop that houses 18 chickens near their homes. They inquired what fencing, livestock regulations and maximums and documentation for companion/service animals were required in the Village and requested that appropriate code regulations be upheld to benefit and protect all residents.

Director Young noted concern with the number of chickens present and proximity of their coop to neighboring properties. He also clarified that farm livestock are typically not permitted in the Village without an exception. Trustee Lee requested and President Brolley directed staff to look into the matter further for additional discussion at a future meeting.

B. Swearing in the Police Chief Phillip J. Smith

Administrator Zoephel introduced the new Police Chief Phillip J. Smith and shared information regarding his background, training and experience. President Brolley swore in Chief Smith as the new Montgomery Chief of Police and took a group photo with his family.

C. Recognition of Officer Kelli Smith and Records Clerk Kim Winkler.

Chief Smith recognized Records Clerk Kim Winkler for receiving the Law Enforcement Award for Civilian of the Year for Distinguished and Dedicated Service by the Oswegoland Optimists Club. He shared information regarding her service with the Montgomery Police Department, presented her with a recognition plaque and took a photo with her.

Chief Smith also introduced and recognized Officer Kelli Smith who received an Award for Performing Life Saving Measures on an Infant in Medical Distress on May 5th, 2018. He congratulated her for her exemplary efforts and service as a Montgomery Police Officer, presented her with a recognition plaque and took a photo with her.

D. Brock Rolfsmeier and Garrett Burke Regarding Fishing in the Foxmoor Basin.

Garrett Burke shared how he and his six-year-old son, Brock, caught a two-foot-long bullhead catfish while fishing in the Foxmoor Basin and commented on what a fun and exciting experience it was for his family. President Brolley thanked them for sharing their story, shook their hands and took a photo with them.

E. Proclamation for Police Week May 13-19.

President Brolley read the Proclamation observing Police Week on May 13-19th, 2018 and Peace Officers Memorial Day on Tuesday, May 15th, 2018. He called upon all citizens and organizations in the Village to commemorate and honor police officers past and present for their service to their community and requested that the U.S. flag to be displayed at half-staff at all government buildings on May 15th, 2018.

Trustee Sperling moved to approve the Proclamation for Police Week May 13-19. Trustee Jungermann seconded this motion.

F. Proclamation for Lupus Awareness Month.

President Brolley read the Proclamation observing May 2018 as Lupus Awareness Month in the Village of Montgomery and encouraged all citizens to increase awareness, education and services for all people affected by Lupus.

Trustee Sperling moved to approve the Proclamation for Lupus Awareness Month. Trustee Jungermann seconded this motion.

G. Proclamation for Public Works Week May 20-26.

President Brolley read the Proclamation observing the week of May 20-26th, 2018 as National Public Works Week in the Village of Montgomery. He recognized the contributions the Public Works Department and employees make to the health, safety, comfort and quality of life of all residents of Montgomery.

Trustee Sperling moved to approve the Proclamation for Public Works Week May 20-26. Trustee Jungermann seconded this motion.

H. Proclamation for Gun Violence Awareness Day June 1st.

President Brolley read the Proclamation observing June 1st, 2018 as the fourth National Gun Violence Awareness Day in the Village of Montgomery. He shared residents could support this initiative by wearing orange on June 1st to raise awareness about gun violence and encourage responsible gun ownership in their communities.

Trustee Sperling moved to approve the Proclamation for Gun Violence Awareness Day June 1st. Trustee Marecek seconded this motion.

Consent Agenda:

Trustee Jungermann moved to approve Items A-H of the Consent Agenda. Trustee Marecek seconded this motion.

Items for Separate Action:

A.Award of a Contract to American Road Maintenance for 2018 Shared Use Path & Miscellaneous Village Owned Lots Sealcoat in the Amount of $42,948.00.

Engineer Wallers summarized that the $42,948.00 contract to American Road Maintenance included sealcoating maintenance of some municipal parking lots, 8,800 feet of shared use paths and reconstruction of a portion of the path in the Foxmoor subdivision. This contractor previously worked as a subcontractor on Lakewood Creek road projects.

Trustee Heinz moved to approve the Award of a Contract to American Road Maintenance for 2018 Shared Use Path & Miscellaneous Village Owned Lots Sealcoat in the Amount of $42,948.00. Trustee Marecek seconded this motion.

B. Ordinance 1800 Amending Village Code Section 6-10 Regarding Mailboxes (Second Reading).

Administrator Zoephel shared that letters to the residents with reimbursement checks were ready to be mailed. This ordinance increases the reimbursement amount for qualified mailbox damage from $50 to $75. Trustee Lee asked and Administrator Zoephel noted he would report back on how many $75 reimbursement checks were provided overall due to damage during snow removal.

Trustee Bond moved to approve Ordinance 1800 Amending Village Code Section 6-10 Regarding Mailboxes (Second Reading). Trustee Marecek seconded this motion.

C. Ordinance 1799 Authorizing the Purchase of Real Property (1335 Amber Drive) (First Reading).

Attorney Julien shared this nuisance property was located in a flood zone on an unbuildable lot, was foreclosed on, the home was demolished and the bank was willing to sell it to the Village for one dollar. Trustee Marecek inquired and Administrator Zoephel clarified that this vacant lot would be mowed and maintained by the Village and President Brolley summarized this item would come back at a future meeting on the Consent Agenda.

Items for Discussion:

A. Outdoor Dining from VFW Post 7452. Attorney Julien summarized the request made by the VFW Post 7452 to allow for outdoor dining at their facility and music to be played on their patio. VFW Post 7452 Commander Rob Bailey clarified that only prerecorded music was being requested. Trustees Bond and Marecek inquired if approval could include a restriction regarding live bands. Attorney Julien shared staff would add the Class B Liquor License to the outdoor dining provision and also draft an amendment to the liquor code allowing for outdoor prerecorded music.

It ws noted that no Plan Commission involvement was needed as this is an amendment to the liquor license code. Currently none of the outdoor dining location are able to have music outside. Consensus was reached in favor of allowing outdoor dining for the VFW and prerecorded music. Further discussion was had confirming that liquor would be served in the VFW’s existing covered patio subject to outdoor dining provision parameters and food service controls. Final discussion was had regarding potentially amending the outdoor dining provision of the code to allow for prerecorded music with clearly outlined limitations regarding no live music, specified volume limits and hours music could be played. President Brolley summarized that the Board and Chief Smith were supportive of this request and staff would bring this item back for waiver of first and passage on the second reading at a future meeting.

New or Unfinished Business:

Trustee Marecek shared the Montgomery Police Department’s Cops on Top Event would take place on Friday, May 18th, 2018 from 5 a.m. to noon at both Montgomery Dunkin Donuts locations to support the Special Olympics. The Sunday in the Park Event will take place at the Lakewood Creek Park on Sunday, June 24th from 4 - 7:30 p.m. CK & the Gray will perform on stage and food trucks, games and activities will be available for residents. Engineering Enterprises Inc. is sponsoring free ice cream from 4:00 - 5:00 p.m. at this great family event for the community.

Trustee Sperling shared numerous Rotary Club of Montgomery projects including their Adopt a Highway Program and new signs on Route 30, third annual VFW Flower Planting Event (postponed to a future date) and Tree Planting Event at the Lakewood Creek School Park on Thursday, May 17, 2018. She thanked Trustee Jungermann and Twin Oaks Landscaping for providing garden material donations and for helping to coordinate and establish a Community Garden at Krug Elementary School. Trustee Jungermann also thanked the Home Depot in Aurora for their assistance.

Trustee Lee shared that Dickson Murst Farm had a very successful annual Day at the Farm Event on Sunday, May 13th with over 2,000 residents in attendance.
