Pro-taxpayer legislation sponsored by State Senator Don DeWitte (R-St. Charles) that enables counties to lease out their high-speed fiber optic cables has been signed into law.

“Legislators must always be looking for ways to decrease the tax burden on Illinois residents, and while technically complex, SB 3173 is absolutely a pro-taxpayer initiative,” said DeWitte. “This new law empowers counties to recoup initial investments when a fiber optic network is installed along key thoroughfares. As businesses and individuals tap into the high-speed cables, it evolves into a revenue-generating asset. Introducing new, non-taxpayer-based revenue streams reduces counties’ reliance on property taxes. It’s a victory for counties and its taxpayers alike.”

The need for the legislation was brought to DeWitte’s attention by Kane County officials seeking to lease out surplus fiber deployed several years ago. In response, DeWitte filed Senate Bill 3173 (Public Act 103-0947) on Kane County’s behalf.

“Kane County has made significant investments in our fiber optics and digital infrastructure,” said Kane County Board Chair Corinne Pierog. “This legislation, which also received support and assistance from Assistant Senate Majority Leader Linda Holmes, allows us to license or lease the County’s fiber optic infrastructure, which is essential for improving broadband access. By partnering with service providers, we can recover our initial investment while enhancing regional access to critical digital infrastructure. Our goal is to collaborate with service providers to deliver comprehensive broadband services, including Internet, voice, data, and video throughout Kane County.”

The provisions of SB 3173 take effect on January 1, 2025.
