City of Batavia City Council met March 4

Here are the minutes provided by the council:

1. MEETING CALLED TO ORDER

The Mayor called the meeting to order at 7:00 p.m.

2. INVOCATION followed by PLEDGE OF ALLEGIANCE

Ald. Cerone led the Pledge of Allegiance

3. ROLL CALL

8. PRESENTATION: Severe Weather Preparedness Week March 4 – 8 (Mark Davis)

Mark Davis ASDA Manager gave a presentation that started with a correction to the alarm schedule. Manager Davis indicated the 7-minute horn will not sound on 3/6/24 but the regular one minute test will happen on 3/5/24. The Council saw a 3-minute video that Davis produced about the outdoor warning system. He noted that the video can be watched on facebook but not currently on the City website.

9 CHAMBER OF COMMERCE

President Margaret Perreault gave an update on Shiver by the River. She noted the Inspire Celebration to honor Dave and Marge Brown as 2023 Batavia Citizens of the Year on April 25, 2024 at Revelry 675. Jake Wolfe was introduced and he gave an overview of his two businesses.

a. ORDINANCE 2024-003: Amendment to the Comprehensive Plan Land Use Map from General Commercial to Mixed Use (DMR 1/19/24 COW 1/23/24 13/0) CD

Motion by Ald. Wolff , seconded by Ald. Malay to approve the Ordinance. Motion carried 13 yea/ 0 nay/ 1 absent

b. ORDINANCE 2024-004: Amendment to the Zoning Map from GC General

Commercial to MU Mixed Use Zoning District with Planned Development Overlay District (DMR 1/19/24 COW 1/23/24 13/0) CD

Motion by Ald. Wolff , seconded by Ald. Malay to approve the Ordinance. Motion carried 13 yea/ 0 nay/ 1 absent

c. ORDINANCE 2024-005: Text Amendment for the Zoning Code to allow certain uses as a Conditional Use in the MU Mixed Use District (DMR 1/19/24 COW 1/23/24 13/0) CD

Motion by Ald. Wolff, seconded by Ald. Malay to approve the Ordinance. Motion carried 12 yea/ 1 nay/ 1 absent

d. ORDINANCE 2024-007: Conditional Uses for a Motor Vehicles, Sales and Leasing, New and Used (DMR 1/19/24 COW 1/23/24 13/0) CD

Ald. Wolff noted that a discussion was had regarding a question about traffic concerns at an earlier meeting. He added that since the original use of the property was a Sam’s Club, the level of traffic generated was more than the new use will generate. Since the traffic generated with the new uses will be less than originally designed, no traffic restrictions were issued.

f. RESOLUTION 2024-009-R: Preliminary/Final Plat of Subdivision for Batavia Square Subdivision (DMR 1/19/24 COW 1/23/24 13/0) CD

11 MOTION: Direct Staff to negotiate a contract for the South River Street Study with Houseal Lavigne

14 ADMINISTRATOR’S REPORT

Laura Newman, City Administrator delivered her report to the City Council. Newman indicated that issues with Code Red have been resolved. She mentioned that there will be a special meeting on March 13th to discuss plans for the Ashton Ridge development on the former Sieman’s property.

15 OTHER BUSINESS

Ald. Malay mentioned that the Batavia Middle School band ensemble would like to perform before the Council at one of their future meetings.

16 MAYOR’S REPORT

Mayor Schielke shared that he met with some realtors who want Chicago residents to move out to Batavia because they are impressed with the City. The Mayor also mentioned early voting has started and that Batavia had one of the higher voting tallies communities in the area.

Ald. Solfa arrived at 8:03 p.m.

17 ADJOURNMENT

There was a motion and a second to adjourn the meeting. The meeting adjourned at 8:07 p.m
