Geneva Committee of Whole discusses real estate transactions

Meeting 04

At a recent meeting, the Geneva Committee of the Whole held a closed session to discuss real estate transactions involving the city.

AUGUST 8, 2016

Present: Mayor Burns, Ald. Bruno, Burghart, Cummings, Kilburg, Maladra, Marks, Radecki,

Simonian, Seno, Singer

Staff Present: Dawkins, Antenore, Tymoszenko, Babica, Schiber, VanGyseghem, DeGroot

1. CALL TO ORDER

Chairman Radecki called the meeting to order at 7pm noting all aldermen were present.

2. APPROVE COMMITTEE OF THE WHOLE MINUTES FROM JULY 13, 2016, JULY 18, 2016 AND

JULY 25, 2016.

Moved by Ald. Kilburg, second by Ald. Marks V/V: 10-0 Motion carried.

3. ITEMS OF BUSINESS

a. Oath of Office and Pinning Ceremony for Fire Chief Michael K. Antenore

Mayor Burns welcomed new Fire Chief Antenore and his family and performed the oath of office.

Antenore thanked his family, colleagues and the council for their confidence and was looking

forward to continuing his firefighter career in this new role.

b. Fire Dept. Promotion/Pinning Ceremonies for Lieutenants Steve Jones, Joel McNally, and

Scot Helmlinger.

Mayor Burns performed the oath of office for the new lieutenants and wished them well. Jones,

McNally and Helmlinger introduced their families and were congratulated by fellow fire staff and

the council.

c. Recommend Approval of Special Event Application for the Zellmer Childhood Disease

Foundation’s Trick or Trot 10K Run Sunday, September 25, 2016.

Moved by Ald. Cummings, second by Ald. Bruno

Organizer Paul Zellmer was present to answer questions. V/V: 10-0 Motion carried.

d. Recommend Approval of Special Event Application for Chicago Race Management’s Oh La

La Chocolate 5K Run Sunday, November 6, 2016

Moved by Ald. Singer, second by Ald. Seno V/V: 10-0 Motion carried.

e. Recommend Approval of Special Event Liquor Licenses for Fiora’s, The Little Traveler, and

Geneva Wine Cellars – Festival of the Vine 2016

Moved by Ald. Seno, second by Ald. Bruno V/V: 10-0 Motion carried.

f. Recommend Waiving of Bidding Process and Authorize Purchase of Membranes from

Dow Water & Process Solutions at a Cost Not to Exceed $138,225.00.

Moved by Ald. Marks, second by Ald. Bruno V/V: 10-0 Motion carried.

g. Recommend Approval of a Draft Resolution Amending the City’s Comprehensive Plan to

Change the Future Land Use Designation for the Subject Realty from “Single Family

Residential” to Single-Family Attached Residential” – K Hovnanian Homes.

The following persons spoke in opposition to the development:

Brian Kay, Brigham Way

Doug Strom, South Street

Todd Augustine, Fargo Blvd.

Nathan Miller, Galway Court

Rhonda Merchut, Fargo Blvd.

Ron Bukowy, Galway Court

Representatives from K. Hovnanian Homes presented information and drawings of the proposed

development, stating that the market was driving the interest and need for this type of

development. They stated their intentions were solely to build the 2 family duplex properties

and would enter into covenants for additional assurances. Discussion on splitting the zoning

amendment into two districts, one for two-family dwellings and one for three-family dwellings

was heard. Dir. DeGroot did not want to comment on that without the City’s legal counsel

available to research case law on that issue.

Roll Call: Ayes: 6 Nays: 4 Motion carried.

Based on the discussion of splitting the zoning, Ald. Radecki entertained a motion to continue

the next two discussion items to a Special Committee of the Whole meeting on August 15.

h. Recommend Approval of a Draft Ordinance Rezoning (Zoning Map Amendment) the

Subject Realty from the R1 Low Density Single-Family Residential District to the R6

Medium Density Two-and Three-Family Residential District – K Hovnanian Homes

(continued to Special Committee of the Whole on August 15, 2016)

i. Recommend Approval of a Draft Resolution Approving a Preliminary/Final Plat of

Subdivision for Geneva Meadows Subdivision – K Hovnanian Homes

(continued to Special Committee of the Whole on August 15, 2016)

j. Consider Draft Resolution Proposing the Increase of Rate of Non-Home Rule Sales Tax in

the City of Geneva, IL

Discussion centered on having adequate time to educate the community before the November

ballot. Aldermen reached consensus to approve an amended resolution to be placed on the

April 2017 ballot.

Ald. Maladra, with a second by Ald. Bruno, moved to amend the motion to include the April 2017

election date.

Roll Call on amendment: Ayes: 9 Nays: 1 Motion carried.

Moved by Ald. Marks, second by Ald. Maladra, to approve the Resolution as amended:

4. NEW BUSINESS

5. CLOSED SESSION FOR THE PURPOSE OF DISCUSSING THE PURCHASE, SALE, OR LEASE OF

REAL PROPERTY FOR THE USE OF THE PUBLIC BODY.

Roll Call: Ayes: 10 Nays: 0

The meeting was adjourned to closed session at 10:07pm

On a motion by Ald. Marks, second by Ald. Bruno, the meeting was brought back to open session

at 10:39pm.

6. ADJOURNMENT

On a motion by Ald. Simonian, second by Ald. Marks, the meeting was adjourned by unanimous

voice vote at 10:40pm.
